# BREAKING NEWS: Asbestos contractors barred from appointing the clearance analyst

From 25 November 2027, in England, Wales and Scotland, the contractor carrying out licensed asbestos removal can no longer appoint the analyst who checks the site is clean for reoccupation. Until then, the current rules apply.

If your school or trust is tendering a removal contract that will run beyond that date, check who the tender says will appoint the analyst. If clearance is bundled into the contractor's price, ask who makes the appointment. That's the part the new rule changes.

HSE says the aim is to keep the clearance assessment independent of the contractor whose work is being checked. It plans to update its Approved Code of Practice and Asbestos: The Analysts' Guide later in 2026. **Technical note:** from 25 November 2027, whoever appoints the analyst must ensure they are accredited by an appropriate body as competent under the ISO 17020 and ISO 17025 paragraphs covering the specified matters.
