# Academy trust notices to improve: what it all means

 by [**Richard Melis**](https://statlog.co.uk/statlog-news-insights/author/richard-melis) on 3 Nov 2026, 18:34:11

Recently, a trust got in touch. They were putting sturdier processes in place to manage compliance and premises, and during the conversation they mentioned they'd been put on the register earlier this year. I knew of the register, but I'd never had reason to look at it properly. So that's what I did.

I also know a number of people reading this are filling out their School Estate Management Standards return right now, and some of the answers may feel thinner than the person filling them in would like. Perhaps in the back of your mind sits the same quiet question: could any of this end up somewhere worse?

To answer it, I read every notice to improve the Department for Education has published since 2021 — all 47 of them, on the public register. Here's what I found.

## What a notice to improve actually is

It's a formal letter the Department for Education (DfE) can send an academy trust when it believes the trust has breached the rules it agreed to. The letter lists what has gone wrong, sets out conditions in an annex, and the trust proves it has met them. The notice is lifted "when the requirements set out in the annex have been met in full" \[2\]. Of the 47 on the register, 24 have closed \[1\] — some because the trust met its conditions, some because a school or trust closed. A notice ends. It is not a permanent mark.

## What the letters are typically about

Based on the historic register, these letters are typically financial. This year, eleven of the thirteen notices are responses to financial problems \[1\]. What we can't know is whether that pattern holds — every case is its own, and nothing here says an estate issue could never become a register issue. But the pattern so far is clear, and two letters this year stand apart from it.

Athena Learning Trust's notice, published in October, is about exclusions. The letter says the trust's governance records "do not provide sufficient evidence that the board systematically scrutinised suspension and permanent exclusion trends" \[2\]. St Clare Catholic MAT's notice, published in May, was issued on safeguarding grounds \[3\].

Different subjects, same demand: improve the practice, and show evidence the improvement is happening.

## The estate ground no letter has used

Since the 2024 Academy Trust Handbook, one of the official grounds for a notice has been trustees and the executive "failing to manage their school estate and maintain it in a safe working condition strategically and effectively" \[4\]. The Handbook expects trusts to keep their estate in a safe working condition, including the statutory health and safety duties to everyone in the building — unchanged in the 2026 edition \[5\].

We found no notice explicitly citing that specific ground \[1\]. An official described the bar for using it as "very high", and said it would apply only to trusts failing to engage with the government \[6\].

One letter, from 2025, stands out: a trust received a notice whose annex listed "estates management" among its failings, alongside safeguarding and health and safety — the only letter of the 47 to name it. But the notice's stated grounds were financial management, governance, oversight and safeguarding \[9\]. Estates management appeared among the listed failings, without explicitly citing the specific ground introduced in 2024.

One letter has come closer than any other. In 2024, a trust received a notice whose conditions required its board to provide evidence that trustees and the executive are "managing their school estate and maintaining it in a safe working condition strategically and effectively" \[8\] — the Handbook clause, restated as a condition of the notice.

And if you're doing your School Estate Management Standards return right now, the department's guidance is clear: if your organisation is not meeting the standards, "there is: no penalty … no criticism of you or your team" \[7\]. That reassurance relates to the SEMS return. Existing statutory safety duties still apply.

If the return has shown up concerns, the sensible move is a simple one: put a plan in place to improve the situation, one process at a time. That's exactly the kind of thing the letters ask trusts to show — a board that knows where it stands and is doing something about it.

## The five questions the letters keep asking

Read together, the letters are a free look at what the DfE counts as proper scrutiny. No board needs a notice to find this useful — the questions underneath are worth asking in any board meeting, any term:

1. What are we scrutinising? The governance minutes should show the board looking at the things that matter — exclusions, spending, premises. One letter was issued because its records didn't show that scrutiny happening.
2. What condition is our estate in, and how do we know? The condition data and the condition survey.
3. Are the statutory checks current? The building safety records: fire, electrical, asbestos, water.
4. Are we maintaining the estate, or just reacting to it? The planned maintenance schedule and the contractor records.
5. Would our insurance cover stand up to what we actually do? One trust was put on notice because its cover was found inadequate. It's not about owning a certificate — it's whether the cover matches the risk.

Some answers take minutes; some take a phone call. The register has never once cited a trust on the specific estate ground — but the letters show what the department looks at when it does look.

Most of that list is standard practice. Where evidence is missing, assess the gap, address any immediate safety risks, and agree a plan with clear responsibilities and dates. Condition surveys and maintenance plans cost money, and school budgets have been tight for years.

Knowing about it and planning for it is just good governance — with or without a letter.
